Why Mediation 2018-12-17T18:41:06+00:00

If you are here you will know that mediation is much more cost effective less stressful and quicker and leaves options open to use alternative dispute resolution. We recognise mediation as one of the best pathways.

Though companies and organisations define mediation in many ways, there is more than one definition of mediation and the process of mediation, but the definition given by the Civil Mediation Council (CMC) is most fitting. The CMC says on its web page: ‘Mediation is a process where an impartial person (the mediator) helps two or more people, or groups of people, to discuss and resolve disputes. (CMC)’’ and I totally agree.

If an agreement is reached in mediation, put in writing and signed, it is binding like any other contract. If court proceedings have already commenced, a court order which reflects what was agreed in mediation can be made by agreement of those involved (known as a ‘Consent Order’ or a ‘Tomlin order’).
